GENERAL TERMS AND CONDITIONS OF ONLINE SALE

1- Definitions

For the purpose of purchasing products from the site naduf.com and in relation to the clauses of the general conditions regarding online sales, the following definitions apply:

  • Seller: the company C.T. S.r.l., with registered office in Via Ubertini, 141/C, Tax Code and VAT No. 03281130983, which markets the products through the site naduf.com.
  • Customer: the subject, natural or legal person, who purchases products through the site naduf.com.
  • Consumer: a customer protected by the rules of the Consumer Code (D.Lgs. 206/2005) as a natural person purchasing the product for purposes unrelated to their professional activity.
  • Product: the good or goods described in the online catalogue and purchasable from the site naduf.com, produced and/or marketed by the seller.
  • Contract: the purchase agreement that is finalised by the meeting of the customer's will to purchase the product, manifested by filling out the forms in the "CREATE AN ACCOUNT" section (for users not yet registered on the site) or "LOG IN" or "ENTER YOUR ACCOUNT" (for users already registered on the site) of the naduf.com site, with the seller's will to sell the product, manifested by acceptance and transmitted in the manner described in point 3.
  • Withdrawal: the manifestation, by the consumer, of the will to renounce the purchase already finalised, taking advantage of the protection offered by the Consumer Code (artt. 64ss D.Lgs. 206/2005) and better described in point 6.

2- Purchase procedure

The products purchasable from the site naduf.com are exclusively those indicated and described in the online catalogue of the site. The customer purchases by filling in all the fields of the forms contained on the pages “CREATE AN ACCOUNT” (for users not yet registered on the site) or “LOG IN” or “ENTER YOUR ACCOUNT” (for users already registered on the site) of the site naduf.com. The confirmation of the will to purchase by the customer is given only by selecting the “SEND ORDER” button on the “ORDER” page. Until the aforementioned confirmation is given, it is possible for the customer to return to the previous pages and modify the data entered therein. In any case, the page containing the “SEND ORDER” confirmation button provides and summarises all the data relevant to the purchase and in compliance with the rules of the Consumer Code (art. 52 D.Lgs. 206/2005).

The confirmation of the purchase proposal by the customer is preceded by checking the “I accept the terms of service” checkbox with which the customer declares to have read these general clauses, to have obtained all the information necessary for the informed choice to purchase the product as well as to have obtained the information on the processing of personal data pursuant to D.Lgs. 196/2003. If the customer is also a consumer, at the end of the purchase procedure they must print or save in virtual form these general clauses as established by the Consumer Code (art. 50ss D.Lgs. 206/2005).

3- Conclusion of the contract

The contract is concluded with the acceptance by the seller of the purchase proposal formulated by the customer in the forms regulated by these contractual clauses. In particular, the seller confirms receipt of the purchase proposal and accepts it by summarising all the data by means of a confirmation e-mail that is automatically sent to the customer following receipt of payment. The sending of the confirmation e-mail has the value of acceptance for all legal purposes and determines the finalisation of the contract. The customer is required, in any case, to verify the accuracy of the data contained in the confirmation e-mail and to immediately communicate any anomalies and discrepancies to the seller who will provide for the correction before sending the goods.

The confirmation e-mail contains, among other things, the order code that the customer must reference in all communications with the seller, including the request for withdrawal. The seller is free to accept or not accept the customer's purchase proposal. In case of non-acceptance, the seller will promptly inform the customer via e-mail and will also provide for the refund of the payment previously made through the methods indicated in the next point.

4- Payment of the product

Payment can be made exclusively through one of the following methods:

  • by connecting to the PayPal site and according to the rules indicated therein for payment;
  • payment through the Stripe service and according to the rules indicated therein for payment.

The dispatch of the product is conditional on the completion of the payment.

5- Shipping and delivery of the product

The seller can accept purchase proposals from customers residing or domiciled in the Italian and European territory.

The shipping costs are €5.99 per order and free for orders over €29.00.

The product is shipped via GLS courier. The product will be shipped via courier. The name of the courier and the tracking link to track the shipment will be communicated via email at the time of shipment. Shipping takes place within 2 business days of the completion of the payment made via PayPal or Stripe, depending on the payment method chosen by the customer during the purchase phase.

In the exceptional case of product unavailability or impossibility for another cause to ship within the established terms, the seller will communicate the reasons to the customer and will return any sum collected from the customer by refund on the credit card through the PayPal or Stripe service.

6- Right of withdrawal and return of the product

In the event that the customer is also a consumer, pursuant to artt. 64ss of the Consumer Code (D.Lgs. 206/2005), the customer-consumer can exercise the right of withdrawal without providing any reason. The right of withdrawal must be exercised no later than 14 working days from the date of receipt of the goods.

The right of withdrawal must be exercised in one of the following forms:

  • If You Are a Guest User: Send us an email to the address info@naduf.com indicating your order ID, the surname on the invoice and your email address. Subsequently, you must indicate the products you wish to return and the reason. You will receive an email confirming the "Return Request", and within the next 2 business days you will receive a second email of return authorisation with all instructions on how to proceed with the return of the package.
  • If You Are a Registered Customer: Access your account and go to the "Your account" section and click on "My returns" to start the procedure. You will need to select the products to return and the reason. You will receive a confirmation email of the "Return Request" and within the next 2 days you will receive a second email of return authorisation with all the information on how to return the package.

In any case, the product must be returned in the same condition as received, without any damage and in the original packaging. The products must not have been worn, washed and must have all labels still attached. In case of non-compliance with the procedures, the seller will return the purchased product to the customer, charging the latter for the additional shipping costs. In case of full and correct application of the withdrawal procedure, the seller will refund the price of the product to the customer by credit through the PayPal or Stripe service chosen at the time of purchase.

8- Online Dispute Resolution (ODR)

In accordance with EU Regulation No. 524/2013, we inform consumers that a European Online Dispute Resolution (ODR) platform is available, accessible at the following link: https://ec.europa.eu/consumers/odr.

The ODR platform is a tool made available by the European Commission to facilitate the out-of-court resolution of disputes relating to online purchases between consumers and professionals.

9- Privacy and treatment of personal data

The customer, by sending the order via the “SEND ORDER” button contained on the “ORDER” page, declares to have read the information relating to the processing of personal data (D.Lgs. 196/2003) available on the “PRIVACY” page of the site naduf.com and to consent to the processing of data for the purposes indicated therein.
